Introduction

This term regulates the relationship between Dinabytes and you. Using our services automatically means that you accept the terms laid here. If you don’t agree with it you should not engage my service.

Service Scope

Dinabytes provides technology solutions, including but not limited to:

  • Custom software development
  • Web and Mobile Application Development
  • AI-powered solutions
  • IT consulting and maintenance

The extent of each project will be further specified within a contract or a proposal presented to the client.

Client Responsibilities

To ensure timely and successful project delivery, the client agrees to:

  • Ensure all provided data, materials feedback and approvals are submitted as agreed schedule in terms of timing.
  • Check its credibility and make it absolutely precise.
  • In a particular project, identify one of the project managers or a key team member as the contact person for conceiving and organizing communications and decisions during the project life cycle

Note: Delays may result from failure in providing required data or approval within the expected time required. By Client Delays Dinabytes shall not be held liable for any and all late delivery.

Project Timeline

  • Schedules of project delivery are based on the availability of underlying data, clients’ response, and work scope.
  • According to the timelines presented in the plan of the project, Dinabytes can change planned timeframes and/or priorities as needed due to such factors as delays at the client’s end or shift to a different approach in the project.

Payment Terms

  • Terms of payments and other requirements will be agreed in more detail in the formal writing.
  • Delays might also be expected, or a number of projects may be put on hold because the user has not cleared his or her dues.
  • Fees paid are not refundable except that specifically agreed to by both parties in writing.

Revisions and Scope Changes

  • The client may ask for changes during the project development phase so long as they are within the specified range of the project.
  • Extra work or alteration of the order beyond what was agreed at the onset shall be treated as new work and a new agreement, time line and cost estimate may be assigned for the new work.

Confidentiality

  • Strong skills and strict adherence to protecting the client data and information and other proprietary information are in place at Dinabytes.
  • The parties also recognize the confidentiality of information that may be disclosed during the project and undertake not to disclose this information to third parties.

Limitation of Liability

Dinabytes will use reasonable efforts to deliver projects to the customers under the agreed terms. However, we are not liable for:

  • Such as delay by the client in providing inputs that are supposed to guide the work being done.
  • Damage costs occasioned by the utilization or misapplication of the systems that were delivered.

Termination

The rights and remedies of either party under the agreement are reciprocal and may be exercised under the provisions of this Act or at law, where the other party fails to perform its obligations under the agreement and the agreement may be terminated by the other party by notice in writing.

The client will also pay for all the completed work up to the time that the contact was terminated.
